How Do I Obtain Asylum or Refugee Status?

In most situations, you will need to have fled from your home country if you are looking to request refugee status. However, prospective refugees must still apply from outside the United States. You must obtain a referral from the U.S. Refugee Admissions Program (USRAP) before you can formally request refugee protection. Once you have a referral, you will need to gather evidence, fill out the appropriate paperwork, and submit an affidavit. You will eventually meet with an immigration official who will make a final decision in your case. 

You can seek asylum status “affirmatively” or “defensively.” If you are already in the United States, you can “affirmatively” (or voluntarily) request asylum protection within one year of your entry.
